You shall provide us with true and accurate information when registering and shall maintain and update that information as applicable. You authorise us to use any information provided to us during the registration process to verify your information (including any updated information).

To register you shall provide us with information including your full name, address, phone number, e-mail address and company name acceptable by Trading FMCG. You represent and warrant to Trading FMCG that the information you provide during the registration process (and any notification of change of such information) is true and correct.

You are obliged to notify Trading FMCG of any changes to your registration information immediately.

Trading FMCG reserves the right to reject any registration and to refuse to provide the Services to anyone for any reason, in its sole and absolute discretion.

If you provide false or incorrect registration information or do not notify Trading FMCG of changes to your registration information immediately, Trading FMCG reserves the right to suspend or terminate your account immediately and without notice to you.

You agree that you shall not (and you agree not to allow any third party to):

1. modify, adapt, translate, or reverse engineer any portion of the Site and/or the Site Service;
2. remove any copyright, trade mark or other proprietary rights notices contained in or on the Site and/or the Site Service or in or on any content or other material obtained via the Site and/or the Site Service;

We have no obligation to verify the identity of any users when they are connected to the Site or to monitor material provided by them.

The Site and the Site Service relates solely to fast moving consumer goods and related products. 

Trading FMCG has made every effort to ensure that the listing of the Goods and Services on the Site is accurate, current and complete and is not otherwise misleading or deceptive or fraudulent. However, we cannot guarantee that the listing and display of Goods and Services is free of errors and fraudulent activity.

The below provisions apply to any and all content which a buyer contributes to the Site and/or the Site Service, and to any interactive services associated with it.

You are solely responsible for any content that you submit, publish or display on the Site or transmit to other Site users.

Trading FMCG reserves the right to refuse you access to the Site or the Site Service if you are in breach of these Terms.

Your Grant: By accepting these Terms and listing any Goods or Services, you grant Trading FMCG and its affiliates a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, right to exercise all copyright, database rights and rights of publicity over the material displayed in any existing or future media, known or unknown, now or at any later date, or in any Feedback.

Trading FMCG reserves all right, title and interest in its and its affiliates’ intellectual property rights (including, without limitation, any patents, trademarks, service marks, registered designs, applications for any of the foregoing, copyright, database rights, design rights, know-how, confidential information, trade and business names and any other similar protected rights in any country) in the Site and the Site Service. Any goodwill accruing out of the use of Trading FMCG and its affiliates’ trademarks, trade and business names and service marks under these Terms shall vest and remain vested solely in Trading FMCG and its affiliates, as the case may be.

Losses not Excluded: Nothing in these Terms shall exclude or limit Trading FMCG’s liability under the tort of deceit, for death or personal injury caused by any breach of duty; or any other liability to the extent that, under applicable law, it cannot be excluded or limited.

Non-Contractual Liability: Trading FMCG does not accept, and excludes, to the extent permitted by law, all liability for breach of any obligation or duty to take reasonable care or exercise reasonable skill other than any such obligation or duty arising under these Terms.

Indirect Loss: To the extent permitted by law, Trading FMCG shall not be liable in contract, tort or otherwise howsoever for any of the following losses or damage (whether or not such loss or damage was foreseen, foreseeable, known or otherwise): loss of revenue, loss of actual or anticipated profits, loss of contracts, loss of the use of money, loss of anticipated savings, loss of business, loss of opportunity, loss of goodwill, loss of reputation, loss of, damage to or corruption of data, or any indirect or consequential loss howsoever caused (including, for the avoidance of doubt, whether such loss or damage is of a type specified in the foregoing), whether arising out of, or in connection with, or in relation to any Goods or Services supplied under these Terms or the supply or non-supply or purported supply or delay in supply of any Goods or Services under these Terms or otherwise out of or in connection with or in relation to these Terms or any transaction or matter contemplated by it, the Site, the Site Service, the inability to use the Site Service or those resulting from any Goods or Services purchased or obtained or messages received or feedback.

We may, at our discretion and without notice suspend, terminate, modify or vary content available on the Site and restrict access to, and availability of, the Site. We will try to make our website available but cannot guarantee that our Site will operate continuously or without interruptions or will be error free and can accept no liability for its unavailability. The express terms of these Terms, the Privacy Policy and the Cookie Policy constitute the sole and entire agreement between Trading FMCG and the Site users in relation to the Site Service and the use of the Site, and supersedes all prior written and oral arrangements, understandings, representations, warranties and agreements between them in that regard (if any). Each Site user acknowledges that it is not relying, and shall not seek to rely, on any arrangement, understanding, representation, warranty, agreement, term or condition which is not expressly set out in these Terms.

If the whole or any part of a provision of these Terms is or becomes illegal, invalid or unenforceable under the law of any jurisdiction, that shall not affect the legality, validity or enforceability under the law of that jurisdiction of the remainder of the provision in question or any other provision of these Terms and the legality, validity or enforceability under the law of any other jurisdiction of that or any other provision of these Terms.

Nothing in this Agreement shall create, or be deemed to create, a partnership, joint venture, or the relationship of principal and agent, between Trading FMCG and a buyer, and no buyer shall have any right or authority to act on behalf of Trading FMCG to bind it in any way.

Each of the rights of each party under this Agreement may be exercised as often as is necessary, is cumulative and not exclusive of any other rights which that party may have under these Terms, law or otherwise; and may be waived only in writing and specifically. Delay by Trading FMCG in exercising, or the non-exercise by Trading FMCG of, any such right shall not constitute a waiver of that right.

Trading FMCG reserves the right to change these Terms or any policies or guidelines governing the Site or Site Service, at any time and in its sole and absolute discretion. Any changes shall be effective upon posting of the revisions on the Site. Changes to referenced policies and guidelines may be posted without notice to you. We advise you to read the most recent Terms before use of the Site. Your continued use of this Site and the Site Service shall constitute your acceptance to any such modifications or changes. If you do not agree to any changes or modifications, you shall refrain from using this Site or the Site Service.
